Black Cube Revealed as Author of Negative Report on Evolution

Court documents recently unsealed in New Jersey’s Atlantic County Superior Court reveal that Israeli intelligence firm Black Cube conducted the inquiry into the operations of Evolution. The findings stem from a 2021 complaint lodged with the New Jersey Division of Gaming Enforcement (DGE) by the law firm Calcagni & Kanefsky (C-K), based in New Jersey.

The complaint suggested that Evolution’s live casino offerings, such as roulette, blackjack, and craps, had been accessed from countries where online gambling is prohibited, including those under U.S. sanctions like Syria, Iraq, and Sudan. These claims led to concerns about Evolution’s suitability to hold an online gaming license in New Jersey.

However, the DGE investigation found no evidence that Evolution intentionally allowed its services to be used in these restricted markets. In response, Evolution filed a defamation lawsuit against C-K.

NJ Supreme Court Rules in Favor of Evolution

As part of the lawsuit’s discovery process, C-K sought to keep the identity of the investigative firm confidential. That request was denied by Judge John Porto and upheld by the New Jersey Supreme Court. On Monday, C-K publicly confirmed that Black Cube was the firm behind the investigation, though it maintains it does not know who hired them.

C-K does not know the identity of the entity or individual who engaged Black Cube to perform the investigation on which the Report is based. C-K has asked Black Cube to provide that information and will supplement its interrogatories when Black Cube does so.

C-K’s Thomas Calcagni also affirmed in a court filing that neither he nor his firm has access to the identity of Black Cube’s client.

Evolution Demands Identity of Report Commissioner

Evolution’s lawyers argue that C-K collaborated closely with Black Cube and should have access to the identity of whoever commissioned the probe. They are urging the court to rule that the firm has delayed proceedings unfairly.

In December, Evolution acknowledged that some of its games were accessed via unlicensed platforms in the UK but insisted the issue had been corrected. It continues to deny any intentional involvement in black-market operations.

Black Cube is standing by its findings. In a statement, the firm asserted that its report uncovers widespread misconduct and illegal operations by Evolution and claims to have obtained new evidence challenging the company’s denials. Black Cube said it will present this information to regulators and courts as necessary and remains committed to pursuing legal action to ensure transparency.
